You are permitted to install and use the font software on up to five computers in any single establishment, in one location. There are no limits on what printing or image setting devices are used, providing the installation of the font software is not allowed to remain resident on more than 5 such output devices - and if any of these limits are exceeded then a separate or additional licence must be obtained from the vendor. 2. This transaction does not transfer any rights of ownership to you, it is merely a licence that permits the authorised use (as defined by these terms) of this font software. Aah Yes Fonts owns this font software and the intellectual property therein, and asserts its right to be identified as the owner of such font software and intellectual property, and other than your right to use the font software as is granted by this licence, all other rights - including but not limited to trademarks, trade names, the title of the font and the font software - are owned and retained by Aah Yes Fonts. 3. You may not re-distribute this font software, or copy it for re-distribution, or pass it on to third parties. It is your responsibility to ensure that this font software is secure and that unlicensed copies do not leave your possession. You may not sublicence, sell or resell, lease, rent, regenerate, give away or allow the unlicensed use of this software and are obligated to take reasonable precautions that none of the above occur. You are, however, permitted to make a single backup copy of this software provided it is subsequently used only in accordance with these terms by the original purchasers. 4. You may not modify this font software in any way (including but not limited to decompiling, reverse engineering, altering or adapting, changing certain components of the font and passing it off as your own, in part or in full.) 5. The software may be returned or exchanged only if defective. Defective software will be replaced if accompanied by an appropriate and valid sales receipt within sixty days of the purchase date. 6. There is no guarantee (express or implied) that this software is appropriate or aesthetically suited to a specific requirement or for a particular purpose. Aah Yes Fonts shall (under no circumstances whatsoever, either envisioned now or arising in the future) be liable to the licensed user in the event of any damages or loss of business (real, direct, indirect or consequential) which may arise from an inability to use this product. Aah Yes Fonts's maximum liability will be the replacement cost of the font software. 7. Embedding of Aah Yes Fonts is allowed provided it is in a secure environment, such as in a PDF to a printer (and similar secure narrowcast situations), however unsecured embedding of this software in digital documents intended for mass re-distribution on the internet (or other non-secure broadcast situations) is not permitted. In other words it is perfectly acceptable to embed our fonts in a PDF being sent for print, but it is not permitted to embed our fonts in an unsecured PDF for mass re-distribution on the internet. 8. Any breach of the terms of this Agreement shall be considered a cause for termination, and in the event of termination, and without limitation of any remedies under law and equity, you agree to immediately return the Font Software to Aah Yes Fonts or the vendor and certify that no copy remains in your possession or control. |
